has this user also got the default user role checked still?

Correct Mark, but this cannot be unchecked. It is the default :(

Ive just tried creating a 'muted' role and the same thing happens here, members with no permission to post comments can still post to the newsfeed

I just tried something else and unchecked all permissions for my muted group, by rights they should not have any permissions however the user under this user-role can still do everything because they are being overwritten by the standard/default roles

Seems we are all just confused. Check the screenshot attached and make sure you disabled the Allow comments option for Newsfeed.
